Acceptable Use Policy

1. Purpose and Scope

This Acceptable Use Policy ("AUP") defines the permitted and prohibited uses of NeuroBit LTD's connectivity infrastructure services. This policy applies to all users, including direct customers, reseller partners, and end users of our Services.

By using our Services, you agree to comply with this AUP. Violation may result in immediate suspension or termination of Services, and potential legal action.

2. Permitted Uses

Our Services are designed and authorized for legitimate business purposes, including:

  • Market Research: Gathering publicly available information for competitive analysis, pricing research, and market intelligence
  • Data Collection: Web scraping, data aggregation, and business intelligence from publicly accessible sources
  • Technical Testing: Quality assurance, performance testing, website monitoring, and infrastructure validation
  • Proxy Services: Providing proxy infrastructure for legitimate business operations and research purposes
  • SEO Monitoring: Search engine ranking verification and SEO analysis
  • Ad Verification: Monitoring advertisement placement and performance
  • Price Monitoring: Tracking publicly available pricing information for business purposes
  • Content Delivery: Geographic content testing and delivery verification

3. Prohibited Activities

The following activities are strictly prohibited and may result in immediate service termination and legal action:

3.1 Illegal Activities

  • Any activity that violates UK law or the laws of any jurisdiction
  • Unauthorized access to computer systems, networks, or data (Computer Misuse Act 1990)
  • Fraud, identity theft, or financial crimes
  • Distribution, possession, or access to illegal content (child exploitation material, terrorist content, etc.)
  • Money laundering or terrorist financing
  • Intellectual property infringement or piracy
  • Sale or distribution of illegal goods or services

3.2 Abuse and Harassment

  • Sending unsolicited bulk communications (spam, phishing)
  • Harassment, stalking, or threatening behavior
  • Hate speech or content promoting violence or discrimination
  • Cyberbullying or doxxing
  • Non-consensual distribution of private images or information

3.3 Security Violations

  • Hacking, cracking, or penetration testing without authorization
  • Distributing malware, viruses, or malicious code
  • DDoS attacks or network flooding
  • Port scanning or network reconnaissance without permission
  • Exploiting security vulnerabilities for malicious purposes
  • Password cracking or brute force attacks
  • Circumventing security measures or access controls

3.4 Network Abuse

  • Excessive bandwidth consumption affecting service quality for others
  • Operating open proxies without proper security controls
  • Activities that degrade network performance or availability
  • Unauthorized network monitoring or packet sniffing
  • Creating or participating in botnets

3.5 Terms of Service Violations

  • Violating website terms of service or robots.txt directives when scraping
  • Bypassing rate limits or anti-bot measures in ways that violate applicable laws
  • Creating fake accounts or identity misrepresentation for fraudulent purposes
  • Automated activity that disrupts website operations

3.6 Privacy Violations

  • Unauthorized collection of personal data
  • Violations of UK GDPR or Data Protection Act 2018
  • Surveillance or monitoring without proper legal authority
  • Interception of communications without authorization

3.7 Other Prohibited Uses

  • Reselling or sublicensing Services without authorization
  • Using Services for any purpose that could damage NeuroBit's reputation
  • Impersonating NeuroBit or misrepresenting relationship with us
  • Interfering with other users' access to Services
  • Circumventing usage limits or billing systems

4. Compliance Requirements

4.1 Legal Compliance

Users must comply with all applicable laws and regulations, including but not limited to:

  • Computer Misuse Act 1990
  • Data Protection Act 2018 and UK GDPR
  • Electronic Communications Act 2000
  • Privacy and Electronic Communications Regulations 2003
  • Investigatory Powers Act 2016
  • Fraud Act 2006
  • Proceeds of Crime Act 2002
  • All telecommunications regulations

4.2 Ethical Scraping and Data Collection

When conducting web scraping or data collection, you must:

  • Respect robots.txt files and crawl directives
  • Implement reasonable rate limiting to avoid service disruption
  • Identify your scraping activities with accurate user agent strings
  • Comply with website terms of service
  • Only collect data you have a lawful basis to collect
  • Respect copyright and intellectual property rights

4.3 Partner Obligations

Reseller partners must:

  • Implement KYC (Know Your Customer) procedures for end users
  • Ensure end users agree to and comply with this AUP
  • Monitor and investigate suspected violations
  • Promptly report violations to NeuroBit
  • Maintain records for compliance and auditing purposes
  • Cooperate with law enforcement and regulatory investigations

5. Monitoring and Enforcement

5.1 Our Rights

While we operate as a Mere Conduit provider, we reserve the right to:

  • Monitor network usage for security and performance purposes
  • Investigate suspected violations of this AUP
  • Access account information and usage data as needed
  • Suspend or terminate Services for violations
  • Report illegal activities to law enforcement
  • Cooperate with legal investigations and court orders

5.2 Abuse Reports

If you believe someone is violating this AUP, please report it to: info@neurobitlab.com

Include relevant details such as IP addresses, timestamps, and evidence of the violation.

5.3 Investigation Process

Upon receiving an abuse report or detecting suspicious activity:

  1. We will investigate the matter promptly
  2. We may temporarily suspend Services if necessary to prevent harm
  3. We will contact the account holder for explanation and remediation
  4. We will take appropriate action based on findings

6. Consequences of Violations

6.1 Service Actions

Depending on the severity and nature of the violation, we may:

  • Warning: Issue a written warning for minor first-time violations
  • Suspension: Temporarily suspend Services pending investigation
  • Termination: Immediately terminate Services for serious violations
  • Ban: Permanently ban users from future use of our Services

6.2 Legal Action

We reserve the right to:

  • Report criminal activity to law enforcement
  • Cooperate fully with investigations and legal proceedings
  • Pursue civil remedies for damages caused by violations
  • Seek injunctive relief to prevent ongoing violations

6.3 No Refunds

Services terminated for AUP violations are not eligible for refunds. You remain liable for all fees incurred up to the termination date.

7. Limitation of Liability

NeuroBit operates as a Mere Conduit provider under the Electronic Commerce (EC Directive) Regulations 2002. We are not responsible for:

  • Content transmitted through our Services
  • Actions taken by users or end users
  • Websites accessed or data collected by users
  • Legal liability arising from user activities

Users are solely responsible for ensuring their use of our Services complies with all applicable laws and regulations.

8. Cooperation with Law Enforcement

We fully cooperate with law enforcement agencies and regulatory authorities. We will:

  • Respond to valid legal requests for information
  • Preserve data as required by law
  • Provide testimony or documentation when legally required
  • Report suspected criminal activity as required by law

We may be legally prohibited from notifying you of law enforcement requests.

9. Changes to This Policy

We may update this AUP from time to time to reflect changes in law, technology, or our Services. Material changes will be communicated via:

  • Email notification to registered users
  • Prominent notice on our website
  • Update to the "Last Updated" date

Continued use of Services after changes constitutes acceptance of the updated AUP.
